After reviewing the proposed bylaws Paul was concerned and consulted with the church’s attorney to get clarification. This was done openly in the same way that he had on several previous occasions. Contrary to Mark’s letter in the “145 page document” issued post-firing, at the time of these incidents there was no Mars Hill “policy” pertaining to an elder’s consulting with the church attorney. Under the bylaws then governing, the elders were Directors of the corporation that is Mars Hill Church. Directors are responsible for the day to day governance of the corporation. Under the previous bylaws, any elder having a question regarding legal matters connected to the church essentially had a legal duty to get such questions answered.
